Ministry of Construction works with Vietnam Federation of Civil Engineering Association (VFCEA) on the draft of amended Law of Construction

Ha Noi (July 12th, 2013) – Minister Trinh Dinh Dung hosted a working session between the MOC and the VFCEA on the draft of amended Law of Construction.

Attending the working session, there also were Deputy Ministers Bui Pham Khanh, Phan Thi My Linh, Tran Van Son, heads of the MOC’s functional departments and agencies, VFCEA Chairman Tran Ngoc Hung and Vice Chairman Pham Sy Liem, as well as VFCEA experts.

Minister Trinh Dinh Dung highly appreciated VFCEA – the professional organization of many experienced scientists and experts in construction investment management - for their criticism.

According to Minister Dung, since being enacted in 2003, the Law of Construction had created an important legal framework for mobilizing investment resources to develop and manage the construction field in our country. However, after 10 year of implementation, the Law of Construction 2003 revealed a lot of limitations, among which the biggest ones were lacking in management of different capital sources, overlooking in state pre-control in construction, giving much power to investors in evaluating and approving technical designs, cost estimates leading to capital waste and loss in many state budget funded projects. As the result, debt in construction field lasts for a long time, which in turn badly affects the whole macroeconomy. That’s the reason why the MOC now is drafting an amended Law of Construction 2003 to overcome its limitations. There are some new concepts in the amended Law of Construction, such as construction investment is an continuous progress, different capital sources need different ways of management, it’s necessary to enhance the role and responsibilities of state management authorities and related subjects in construciton field… The Ministry of Construction, according to Minister Dung, hoped to receive criticism, comments and opinions from scientists and experts of the VFCEA to complete the amended Law of Construction.

At the meeting, the VFCEA Chairman Tran Ngoc Hung said the Law of Construciton closely related to many other laws including Law of Land, Law of Urban Planning, Law of House, Law of Real Estate Business, Law of Bidding… and many relevant Decrees, Circulas and Guidance documents, thus it was so difficult and complex to amend the Law of Construction. The VFCEA Chairman agreed with new concepts proposed by the MOC in the amended Law of Construction, and gave his own opinions on these concepts in detail.

Dr. Pham Sy Liem, Vice Chairman of the VFCEA, said it was essential to clearly define many kinds of relationship in construction, such as administrative relationship between state agencies and construction subjects, economic relationship among construction subjects, civil relationship among citizens and between citizens and organizations… Dr. Pham Sy Liem also shared lots of experience learnt from foreign countries, and proposed the Drafting Committee to include these experience in the amended Law of Construction.

Closing the meeting, Minister Dung thanked the VFCEA experts for their precious comments and opinions, and asked the Drafting Committee to receive these comments and opinions to complete the amended Law of Construction.
