Minister Trinh Dinh Dung affirmed : Construction Law 2003 prescribes the scope adjustments for construction activities but the entire contents of the Law to reflect the investment process from construction stages of construction planning, investment preparation, project implementation and puting to use, exploitation projects.
Thus, between the scope and content of the provisions of the Construction Law 2003 does not ensure uniformity, therefore considering amending the scope of the Law and the regulations are necessary.
Through research, evaluation, review and refer to some countries, the Government and the Commission of Science, Technology and Environment of the National Assembly said that the Construction Law (Revised) provides scope for Comstruction Investment activity comes from the requirements and reasons as following:
The first, the process of creating construction projects that is combines elements of capital, land, labor, building materials, construction equipment.
The second, the Construction Investment process forming from the multi-faceted relationship between the entities involved as an investor (who is assigned capital or use capital management), counseling and construction contractors (who perform construction activities).
The third, regulation of Construction Investment activities is the successors and consistencies with the provisions of law in the management of construction investment in our country so far.
Due to these reasons, the Seminar has focused on the following issues :
Innovation management methods and content management project to manage closely for projects using state capital, create favorable conditions for organizations and individuals of the different economic sectors engaged in various construction investment .
To amend and supplement regulations on construction plan to overcome the unplanned construction, ensuring transparency to the approved construction plans .
Increase control, construction quality management control in the first at all stages of the construction process.
Innovation cost management mechanism to manage closely the construction costs from the state capital, to ensure equality of rights and obligations of the participants in the construction contract through. Overcome the prolonged debt, social inequality between investors and employees.
Unified state management of construction order through building permits, ensuring the transparency of the process and procedures for granting licenses.
Clearly defining state management responsibilities for investment in construction activity and assignment level more specific, clearer responsibilities among ministries, sectors and localities.
The participants had opinions to commenting and Construction Law Drafting Committee receptive comments at the Seminar to consider putting into the law.
