Comments to amend the Law on Construction

Ha Noi (August 2nd, 2013) – The Council of Science, Technology and Environment - the National Assembly - coordinated with the Ministry of Construction to hold a conference making comments on the Law on Construction.

After nearly 9 years of implementation, the Law on Construction has enabled both domestic and foreign organizations and individuals to easily operate in the Construction field in Vietnam. However, there are some weakness and limitations in leagal document system on construction investment that should be modified.

During the conference, all participants came to agreement that the amended law should be united in terms of regulations on construction investment, synchronized with other laws, fitted under international practices and other agreements Vietnam had signed before; carrying out the program of administrative reform to facilitate organizations and individuals involved in construction activities, enhancing the state management in construction investment, anti-loss, anti-waste and improving construction quality as well as ensuring investment efficiency.

Minister Trinh Dinh Dung said the amended Law on Construction would adjust construction investment projects using all kinds of capital and throughout their entire process from planning phase, estimating and managing the construction investment project to surveying, designing and building to testing, handing over the buildings to use and maintain. In addition, the amended Law on Construction would modify the relationship between the Law on Construction and Law on Public Investment. According to this amended Law, those projects using the state budget wouldn’t be adjusted in terms of budget allocation and management, but in terms of planning and approving plans as well as other typically features relating to technological economy such as construction plan, standards, norms, total cost, unit rate…

The Secretary General of Vietnam Federation of Civil Engineering Association, Mr. Tran Ngoc Hung, said the amended Law on Construction should keep the regulations related to selecting contractors in stead of those in the Law on Bidding. He thought the Law on Bidding should contain common regulations while specific one should be defined by the Law on Construction, and the Minister of Construction should take responsibility for bidding.

Mr. Hung suggested the amended Law on Construction should include a chapter on supervising, checking and handling violations in construction field, and implement regulations on responsibility of state agencies in managing the construction activities.

Deputy Minister of the Ministry of Transport, Mr. Nguyen Hong Truong, reccommended the amended Law on Constructionm should add some regulations related to responsibility of relevant ministries to supervise, check and monitor the implementation of those specific projects.

During the conference, participants discussed much about construction investment management, construction planning, construction projects evaluation and state agencies’ responsibility in managing construction activities.

The amended Law on Construction is to be submited to the National Assembly XIII for discussion, and for collecting comments at the 6th session which will be taken place in late 2013, and approved at the next 7th session.
