Position, function:The MOC’s Inspectorate (hereinafter referred to as the Ministry’s Inspectorate) is an organization belong the Ministry of Construction, assist the Minister implement provisions of law on the inspection, settlement of complaints, denunciations and prevention anti-corruption; conducted administrative inspection for agencies, organizations, units and individuals under the fields of omanagement of Ministry and specialized inspection for agencies, organizations, individuals operating in the sector under the fields of management ofMinistry of Construction.Ministry’s Inspectorate under the management, direction of the Minister of Construction, and subject to the directio, guidance of the organization and operations of the Government Inspectorate.Ministry’s Inspectorate has its own seal, an account at the State Treasury and the bank as prescribed by law.

Duties, powers:

1. Duties, powers of Ministry’s Inspectorate :

1.1. Chair or participate in drafting the legal documents for submit to the authority to issue; request authority to amend, supplement or promulgate legal documents in accordance with requirements of construction industry;

1.2. To inspect the implementation of policies, laws and responsibilities for organizations, individuals under the management of the Minister of Ministry of Construction;

1.3. Perform duties, powers of the MOC's Inspection under the provisions of Article 5 of Decree No. 26/2013/ND-CP of March 29, 2013 of the Government on the organization and operation of the Inspectorate of construction industry;

1.4. Administrative sanctions as provided by law on handling of administrative violations;

1.5. To propose competent authorities to suspend unlawful behavior of organizations, individuals have sufficient basis for determining violations causing damage to the interests of the State, the legitimate rights and interests of citizens;

1.6. To assist the Minister to aranging meeting with citizens, individuals settlement of complaints and denunciations as prescribed by law;

1.7. To perform the task of preventing and combating anti-corruption, prevention and combating of crime in the construction industry as prescribed by law;

1.8. Guidance, professional training of specialized inspection for Building Inspection Department and officials working in the construction industry inspector in the ministries, local; guide, inspect units of the Ministry of Construction to implement the provisions of the law on inspection, settlement of complaints and denunciations and anti-corruption;

1.9. Periodical reports, reports inspection's results, check to the Minister of Construction and General Government Inspector;

1.10. Perform other duties, powers as assigned by the Minister.

2. Duties, powers of the Chief of Ministry’s Inspectorate:

2.1. Leadership, direction, check the administrative inspection for organizations, ndividuals under the direct management of the Minister of Ministry of Construction and inspection specialized in the fields of management of Ministry of Construction;

2.2. Develop an annual inspection plan submit to the Minister of Ministry of Construction approved and organizing and directing the implementation of inspection plans after approval;

2.4. Submit to The Minister of Construction decisions or decisions by the competent authorities to establish inspection teams, election inspectors, requisition collaborators inspectors perform inspections as prescribed by law;

2.5. Recommendations Minister of MOC to suspend the implementation of the decisions of organizations, individuals under the direct management of the Ministry of Construction has grounds to believe that the decision is unlawful or affect the operation inspection;

2.6. Recommendations Minister of MOC shall consider and handle with violations under the fields of management of Ministry of Construction; in collaboration with the heads of agencies and organizations responsible for the review the responsibilities, processing people with violations under the management of the agency or organization;

2.7. Recommendations Minister of MOC solve the problems of inspection, where a recommendation is not accepted, shall report to the Inspector General of Government;

2.8. Perform duties, powers of the Chief of Inspector of the Ministry of Construction as defined in Article 6 of Decree No. 26/2013/ND-CP of March 29, 2013 of the Government on the organization and operation of the Inspectorate of construction industry;

2.9. Perform other duties, powers as assigned by the Minister.

Structure:

1. The units :

1.1. General Division;

1.2. Division of settle complaints and denunciations;

1.3. Construction's Inspection Division 1;

1.4. Construction's Inspection Division 2;

1.5. Construction's Inspection Division 3;

1.6. Division of prevention, anti-corruption ;

1.7. Division of meeting citizens ;

1.8. Representative Agency of Ministry’s Inspectorate in Ho Chi Minh City.

The Division (Representative Agency) have Chief, Deputy Chief a number of officers, professional staffing norms consistent with the needs, tasks of Ministry’s Inspectorate in each period.

The establishment, reorganization, dissolution and appointment, dismissal, demotion Chief, Deputy Chief of Division belong the of Ministry’s Inspectorate decided by Minister on the proposal of the Chief of the Ministry’s Inspectorate and the Head of Department of the Organization and Personal Department.

2. Leadership of the of Ministry’s Inspectorate:

2.1. The Ministry’s Inspectorate have Chief and Deputy Chief of inspector;

2.2. Chief of Inspector and Deputy Chief of Inspector of Construction Minister appointment, dismissal or demotion by Minister of Construction in accordance with the Party and the law;

2.3. Based on the functions, tasks, powers and organizational structure of the Ministry’s Inspectorate, the Chief of Inspector is responsible for the planning stages, identify staffing needs of the Ministry’s Inspectorate, build and working regulations issued by the Ministry’s Inspectorate; regulating functions, tasks, powers and organizational structure of the division; clearly define authority and responsibility of each individual in the Ministry’s Inspectorate and report to the Minister.

2.4. Chief of Inspector is responsible to the Minister and the law on the entire operation of the Ministry’s Inspectorate, Deputy Chief of Inspector is responsible to the Chief of Inspector and the law on the areas assigned.
