DECISION

on the regulating the functions, tasks, powers and organizational structure

of the Institute of Construction Economics

 

MINISTER OF CONSTRUCTION

 

Persuant to the Decree No 17/2008/ND-CP on the 4th of February 2008 of the Government on the functions, tasks, powers and organization structure of the Ministry of Construction;

In consideration of the proposal of the Director of the Institute of Construction Economics and the Head of the Personnel Department.

DECIDES:

          Article 1: Position and functions:

          The Institute of Construction Economics is a state-owned agency in the Ministry of Construction, which is implementing the functions: researching the development strategy, mechanism and policy on economics and market to help the management activities of the construction industry; scientific research, information, training, international cooperation and doing consultancy services in the state management fields of the Ministry (includes: building; architecture, construction planning; urban infrastructure, industrial zone, economic zone, high technological zone; urban development; residential and official housing; real estate business; construction materials).

          The Institute of Construction Economics has the legal status, the own seal to transact business, is able to open accounts in State Treasury and Banks under the law.

          Article 2: Tasks and powers:

          1. Researching the development strategies, mechanims, policies on economics and market, proposing and taking part in compiling the legal documents to assisst the Ministry of Construction in excercising the function of State management over the fields: building, architecture, construction planning; urban infrastructure, industrial zone, economic zone, high technology zone; urban development; residental and official housing; real estate business; construction materials and public services.

          2. Scientific researching, applying and transfering the management technology on economics and market in the Institute’s functions and tasks under the programs, plans, projects, which are given by the State or the Ministry of Construction, or under the orders, which are given by the agencies, organizations and enterprises.

          3. Researching, proposing the models of organization and operation, the models of production and business management, professional activities’ management, services of the enterprises, professional agencies, services in the fields of State management of the Ministry of Construction; researching, proposing the regulations, policies applied to the officials, public servants and employees in the construction industry.

          4. Researching and building the criteria to be base for assessing the development situation and proposing to define the management mechanisms, policies in the construction industry; researching the methods and building the systems of econo-technical criteria, norms in excercising the management of investment construction cost, construction planning cost, infrastructure service, urban service, housing service to submit for the Ministry of Construction’s promultigation or to promultigate itself under the law.

          5. Researching, appraising the development situation of all kinds of market in the construction industry (building market, construction materials’ market, real-estate market); analysing the basic factors to make the market fluctuation and proposing the solutions in order to stabilize, adjust and impulse the unshakeable development of all kinds of market in the construction industry.

          6. Inquiring, surveying, collecting, summarizing, storing and providing the information, documents on economics to assist the management’s task of the construction industry and to meet the market’s requirements.

          7. Organizing the training, disseminating, introducing the legal documents on economic management and the legal documents of the construction industry.

          8. Organizing the training of the professional knowledge of economics and market to improve the officials, public servants’ capacity in the construction industry and to qualify to do business in the construction industry and real estate business; training the PhD, BA in the Institute’s research fields under the law.

          9. Performing the cooperation, association with the organizations and individuals in the country and international in the Institute’s operation fields under the given functions and tasks.

          10. Performing the economic consulting operation in the management fields of the Ministry of Construction, includes:

          10.1. Consulting to form and manage investment construction projects;

          10.2. Consulting to manage the cost of investment construction projects, includes: forming, assessing the total capital of the investment construction projects, appraising the effectiveness of the investment construction projects; determining the construction norms, unit price, price index; taking off the quantities; forming, assessing the project estimate; selecting the contractors in the construction activities; determining the price of bidding packages and contracts in the construction activities; controling the construction cost; setting up the payment documents, balance sheet documents of the contracts; paying and drawing the balance sheet of investment capital of the investment construction projects and other activities in managing the investment construction cost;

          10.3. Consulting to develop the urban financial resource; to set up and manage the cost of construction planning, infrastructure services, urban services, residental housing; to determining the enterprises’ assets, real estate price; and other consultancy services appropriate to the Institute’s functions and tasks under the law.

          11. Reporting the situation of performing the assigned tasks to the Ministry and other relevant authorized agencies periodically every 6 month, a year and unscheduled under the law.

          12. Managing the organization structure, staffs and officials; performing the salary regulations, commend and reward, disciplinary action and other regulations to the staffs, officials administered by the Institute under the law.

          13. Managing the allotted finance and assets, managing the service activities of the Institute under the law.

          14. Performing other tasks assigned by the Minister of the Ministry of Contruction.        

          Article 3. The Institute of Construction Economics and the Director of the Institute of Construction Economics are responsible to the Minister of the Mininstry of Construction for:

1. Periodically reporting, providing the information and criteria to appraise the development situation in all fields of construction industry.

          2. Periodically reporting, appraising the development situation, the market fluctuations in the construction industry and proposing the opportune solutions to stabilize, adjust and promote the unshakeable development of all kinds of market.

          3. The implementation result is regulated in the Article 2 of this Decision.

          Article 4. Organizational structure

          1. The Institute of Construction Economics has a Director, some Deputy Directors and Divisions, Centers and a Branch.

          - The Director is appointed and dismissed by the Minister of the Ministry of Construction, The Director is the leader of the Institute, is responsible to the Minister and the law for the all Institute’s activities and other Director’s responsibilities regulated in Article 3 of this Decision.

          - The Deputy Directors are appointed and dismissed by the Minister of the Ministry of Construction. The Deputy Directors have the tasks to assist the Director in instructing one or some works of the Institute and are responsible to the Director and the law for their tasks.

          - Each division has a Head and Deputy Heads of division; each Center and Branch has a Director and Deputy Directors. The heads and deputy heads of the Institute’s units are appointed and dismissed by the Director of the Institute.

          Heads of the Divisions, Directors of the Centers, Director of the Branch are responsible to the Director and the Board of Directors of the Institute for the management, implementation of functions, tasks under the law, the regulations of organization and operation, and other regulations of the Institute of Construction Economics.

          2. The units in the Institute of Construction Economics:

2.2. Research Division of Construction Price and Market (Division of Price and Market)

2.3. Research Division of Construction Econo-technical Criteria and Norms (Division of Criteria and Norms)

2.4. Research Division of Investment Construciton Economics and Real Estate (Division of Investments and Real Estate)

2.5. Research Division of Urban Economics and technical Infrastructure (Division of Urban Economics)

2.6. Research Division of International Construction Economics

2.7. Division of General Affairs and Science Management (Division of General Affairs)

2.8. Administration - Personnel Division
2.9. Financial and Accounting Division
2.10. Information Center

2.11. Training and International Cooperation Center

2.12. Consultancy Center of Investment Construction Economics

2.13. Southern Branch of the Institute of Construction Economics

          The new establishment, rearragement, dissolvement of the units in the Institute of Construction Economics are decided by the Minister of the Ministry of Construction in the consideration of the proposal of the Director of the Institute; the regulation of functions, tasks, powers and organization structure of the units in the Institute of Construction Economics are decided by the Director of the Institute.

          3. The Branch and Centers in the Institute of Construction Economics are the non-business units with revenues and financial autonomy. Branch and Centers of the Institute have the rights to have their own seals, to open accounts in the State Treasury and Banks according to the operation capacity and requirements of implementing the functions, tasks, under the granting authority and financial-accounting decentralized administration of the Director of the Institute and other regulations of the law.

          Article 5. This decision takes the effect in 15 days after the date of its promultigation; the stipulations in other documents issued earlier, which are in contrary to this Decree, are now annuled.

          The Head of the Personnel Department, the Chief of the Secretariat, the Director of the Institute of Construction Economics and chief officers of other agencies and units of the Ministry of Construction have to implement this Decision.
